Article 1 — Purpose and scope
These terms and conditions of sale (hereinafter the "Terms") govern all sales of products concluded on the website horsjeurecords.fr between the association HORS JEU Records (hereinafter the "Seller") and any person making a purchase (hereinafter the "Customer").
Placing an order on the website implies unreserved acceptance of these Terms. The Seller reserves the right to amend them at any time; the Terms applicable are those in force on the date of the order.
Article 2 — Seller identification

Article 3 — Products
The products offered for sale are musical media (vinyl records, cassette tapes, CDs) and related items, described and presented on the website as accurately as possible.
Photographs and descriptions are provided for guidance only and do not bind the Seller in the event of a minor difference (sleeve variations, pressings, etc.). Products are offered subject to available stock. Should a product become unavailable after an order is placed, the Customer will be informed and refunded the corresponding amount.
Article 4 — Prices
Prices are stated in euros (€), inclusive of all taxes.
VAT not applicable — Article 293 B of the French General Tax Code.
(The association benefits from the French VAT-exemption scheme for small businesses ("franchise en base de TVA"): no VAT is charged and none is recoverable.)
Prices do not include shipping costs, which are shown separately before the order is confirmed. The Seller reserves the right to change prices at any time, it being understood that the applicable price is the one displayed at the time of the order.
Article 5 — Orders
The Customer selects the products, confirms the basket, enters their contact and delivery details, chooses a shipping and payment method, then confirms the order after accepting these Terms.
Confirmation of the order constitutes conclusion of the sales contract. A confirmation email summarising the order is sent to the Customer. The Seller reserves the right to cancel any order in the event of a payment dispute, a manifestly incorrect address, or other legitimate grounds.
Article 6 — Payment
Payment is made, at the Customer's choice, by:
- PayPal (secure payment, including instalment payment where offered);
- Cheque made payable to HORS JEU Records, sent to the registered office;
- Bank transfer (details provided at the time of the order).
For payments by cheque or bank transfer, the order is prepared and dispatched once the payment has actually been received. Products remain the property of the Seller until the price has been paid in full.
Article 7 — Delivery
Products are shipped to the address provided by the Customer at the time of the order, according to the chosen method:
- Mondial Relay — delivery to a pickup point / locker (France and destinations covered by the carrier);
- La Poste — home delivery, France and international.
Timescales: orders are prepared within 2 at 5 business days, except during peak periods. Transit times depend on the carrier and the destination.
Zones: some destinations may not be served by every carrier (the Mondial Relay pickup-point service does not cover all countries). The available methods and their rates are shown during checkout based on the delivery address.
Costs: shipping costs are calculated and displayed before confirmation. Where a parcel is returned unclaimed, any re-dispatch costs are borne by the Customer.
The Seller cannot be held liable for delays attributable to the carrier or to an event of force majeure.
Article 8 — Right of withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, a Customer who is a consumer has a period of 14 days from receipt of the products to exercise their right of withdrawal, without having to give any reason.
To exercise it, the Customer notifies the Seller of their decision by an unambiguous statement sent to contact@horsjeurecords.fr (or using the model form at the end of this document). The products must be returned in their original condition, complete, within 14 days of communicating the decision to withdraw.
Exception (unsealed recordings): in accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for audio or video recordings that have been unsealed by the Customer after delivery. A record or tape whose sealed packaging has been opened is therefore not eligible for return, except in the case of a defect.
Return costs are borne by the Customer, except in the case of a defective product or an error by the Seller.
Article 9 — Refunds
Where withdrawal has been validly exercised, the Seller refunds the amounts paid, including the initial standard delivery costs, within 14 days of recovering the products or of proof of their dispatch. The refund is made using the same means of payment as that used for the order, unless otherwise agreed.
Article 10 — Damaged products or lost parcels
On receipt, the Customer is invited to check the condition of the parcel. In the event of a product damaged in transit, a lost parcel or a missing item, the Customer should contact contact@horsjeurecords.fr as soon as possible, attaching photographs where possible. The Seller will, as appropriate, replace the product or refund it, after checking with the carrier.
Article 11 — Legal guarantees
Independently of any commercial warranty, the Seller remains bound by:
- the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code);
- the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).
A Customer relying on the legal guarantee of conformity has a period of two years from delivery of the goods to act, and may choose between repair or replacement of the product, subject to the conditions laid down by law.
Article 12 — Personal data (GDPR)
The data collected when placing an order are necessary to process and deliver it. They are intended solely for the Seller and its service providers (carriers, payment service) and are not passed on to third parties for commercial purposes.
In accordance with Regulation (EU) 2016/679 and the French Data Protection Act, the Customer has a right of access, rectification, erasure and objection regarding their data, which they may exercise by writing to contact@horsjeurecords.fr.
Article 13 — Intellectual property
All elements of the website (texts, images, logo, graphic identity) are the property of the Seller or its rights holders and may not be reproduced without prior authorisation.
Article 14 — Disputes, mediation and governing law
These Terms are governed by French law.
In the event of a dispute, the Customer should first contact the Seller (contact@horsjeurecords.fr) in order to seek an amicable solution.
